desire2learn’s website notes that the us patent and trademark office rejected blackboard’s 44 claims on patents that resulted in a $3million lawsuit with desire2learn.

though this is a non-final action, it is certainly an interesting turn of events and should have been resolved before the lawsuit judgement was delivered. either way, it’s a good reminder to keep your patent ducks in order.
